Short-term removals can be a practical tool for districts, as they typically don’t trigger IDEA safeguards or require the provision of FAPE. However, when the removal involves a student with a disability, districts must closely monitor the length to ensure compliance with the law. In this episode, Jeremy and Erin discuss a recent case from Montana where a district’s failure to provide continued educational services during a disciplinary removal led to a denial of FAPE. They share best practices for managing disciplinary removals of students with disabilities, including practical tips for tracking removal days, identifying changes in placement, and staying ahead of critical deadlines and processes under IDEA and Section 504.
