Ep 007: Understanding Mahler, Winters, & Hamm Fees with Bruce Lamb

March 07, 2024 Iron Mind Podcast Season 1 Episode 7

In this episode of the Iron Mind Podcast, Bruce Lamb discusses the importance of enjoying work, effectively managing caseloads, and prioritizing clients' best interests in personal injury practice. Lamb highlighted the shift towards less trial work in personal injury law due to rule changes and the prevalence of mandatory arbitration. This shift has raised questions about the impact on practitioners' litigation skills and the overall dynamics of the legal process. Discussed in the episode was the concept of Equitable Reimbursement in Personal Injury Cases, mainly focusing on the pro rata share of attorney’s fees and the right to reimbursement. The Mahler case set a precedent that insured individuals must pay a pro-rata share of their attorney’s fees in collecting their claim, discouraging claim splitting and emphasizing equitable principles in legal proceedings.
